CD DUPLICATION AND DEVELOPMENT

Terms and Conditions of Service and Supply

1. These terms and conditions govern the contract for the supply of CD BUSINESS CARD duplication and development services as specified in the quote.
2. The services supplied will be carried out by Dream Studio (UK) Limited or by a suitable sub-contractor.
3. The client is responsible for supplying any data or input material to Dream Studio (UK) Limited and any information required in sufficient time to enable Dream Studio (UK) Limited to carry out the service within the agreed timeframe.
4. The client is responsible for retaining duplicate copies of material and data and to insure against its accidental loss or damage. Dream Studio (UK) Limited shall have no liability for any loss or damage thereto howsoever caused.
5. The client shall pay Dream Studio (UK) Limited fees (plus VAT) by the due date specified on the invoice given or according to the agreed payment plan. Failure to pay will result in interest charges of 20% per annum from the due date until the outstanding amount is paid in full.
6. Any material or data designed, built, constructed, programmed or created will belong to The Client providing all fees are paid.
7. Any material or data given to Dream Studio (UK) Limited will remain confidential and returned at the end of the project.
8. The Client is responsible for ensuring that any copyrights are adhered to and acknowledged and all permissions are gathered when using any copyrighted material other than that owned by the client.
9. Dream Studio (UK) Limited warrant that the service offered will be carried out professionally using care and skill. Any subcontracted work will carry the same warranty.
10. Dream Studio (UK) Limited accept no responsibility for any claims being made against the Client of any kind concerning the content of the CD arising from any material given by the Client to Dream Studio (UK) Limited for inclusion in the CD.
11. Dream Studio (UK) Limited shall not be liable for any Client losses of any kind or be held in breach of contract if the service is not provided within the agreed time frame so long as Dream Studio (UK) Limited has taken every effort to ensure prompt delivery.
12. These conditions constitute the entire agreement between the parties and supersede any previous agreement or understanding and may not be varied except in writing between the parties.
13. If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these conditions and the remainder of the provision in question will not be affected.
14. This contract shall be governed in accordance with English law and the parties undertake to submit to the jurisdiction of the English Courts.
